A Producer and Production Company Agreement is a contract used when a production company wants to contract with a producer of instrumental tracks to produce tracks exclusively for the production company. In this agreement the producer agrees to only record masters for the production company and to deliver an agreed number of musical tracks during a specific contract period. In exchange for the producer’s exclusive services, the production company will attempt to sell the tracks to record labels or artists to use the recordings. For the production company’s efforts it will own the recordings and a publishing share of the musical composition written by the producer. The production company will then pay an agreed upon percentage from both the recording and publishing income to the producer. This agreement provides alternative terms for the production company to share a co-publisher’s share of the musical composition income, instead of a full publisher’s share.
