This Side Artist Agreement is used when a record label, artist or
producer hires a musician, singer who is not part of the artist's group
or band to perform on an artist's recording. This is also used with a
featured artist will perform on a rap or hip-hop album with the
recording artist. This agreement is not used when the side artist is a
member of a union. That is covered by the union contracts. It also provides that the
recording of the side artist performance is owned by the record label
or artist (which is usually the case). This
agreement sets forth payment terms to pay the side artist, musician or
vocalist a flat fee for their services along with a royalty for each recording sold, including digital sales. It also provides if the side artist has
made a contribution to words or music to the song then he or she will retain ownership to his or her
part of the song and will receive a mechanical royalty for sales of the
recording including digital sales.
